Federalism


Our founding fathers were brilliant with their concept of “federalism” ... dispersing some powers away from our central government to the states ... saving us from the possibility of a dictatorial president and a looney-tunes Congress. 

However, what they couldn’t have imagined was that we could ever have so many martinet state governors and nutso state legislatures.

Magic 8 Ball


Former Special Counsel Robert Mueller has had his testimony in front of two House committees put off one week until July 24th ... see: The Hill Story. This is just two days before Congress leaves for its six week summer vacation. Now Mueller has previously indicated he will not answer any questions outside the bounds of his report ... which of course Republicans on these committees will not be bound by. They are sure to ask dozens of questions that will be embarrassing to Mueller ... and which he will either not answer or try to dodge.

Therefore these hearings for Mueller will be like to trip to the root-canal dentist without Novocain. Two days before Congress’ summer recess means that any further delays might be permanent. Which is therefore my prediction — Mueller will never sit down to be so questioned in public by Congress ... and most certainly embarrass himself as his swan song from public life.

Fed Mandates


Our  Federal Reserve Chairman Powell testified today at Congress ... and, as often is the case, the mandate of the Fed was mouthed again ... as it often is. It was not questioned. It was just mouthed. I find it interesting that no Congressperson questioned this mandate.

The Fed’s mandate, as previously set by Congress is just two fold: Full Employment (now specified as a 4% unemployment rate) ... and Low Inflation (now specified as a 2% inflation rate). And, interestingly, both these objectives are now being surpassed ... by quite a bit. Inflation is now running at 1.6% and our unemployment rate is at 3.7%. Wow! The Fed has surpassed both their mandates!

Had I been questioning Powell today, I would have asked him if it is not time for Congress to rethink these mandates and, possibly, update or add to them. I have broached this topic before and have some suggestions for some updates for the Fed’s mandates:

- Economic Growth — certainly the Fed assumed this temporary mandate during Obama’s administration with its Quantitative Easing strategy — the huge expansion of its balance sheet by almost four trillion dollars. Basically, this meant the Fed bought huge amounts of government  and mortgage debt ... pumping lots of money into the economy to drive up the prices of assets ... like stocks, bonds and housing ... and thus hold the economy’s head above water.

- Fair Trade — President Trump is in the midst of a trade war with China and other countries to bring down serious balance of payments problems. And trade wars often involve the price of the dollar at those countries with whom we are negotiating new trading policies. A strong dollar can easily negate the impact of any corrective tariffs imposed upon trading foes.

- Monetary Flows — There are such large disparities now between interest rates in the US and elsewhere (as much as 3 percentage points) that this disparity creates huge carry trade imbalances. Yes, right now this may help America finance our deficits ... but this might not always be the case. (Could this same flow be accomplished with a smaller differential?) Therefore, it would seem to this observer that our Fed should keep a wary eye on the difference between world-wide interest rates in setting our own rate ... in order to manage international money flows.

Therefore, rather than just the current mandates, I would suggest adding at least the above three objectives to the Fed's portfolio ... particularly during times when its existing two are being easily met ... like now.

Focus Group Runners


I heard a term recently that made me take notice ... “focus group runners.” Wow! This says a lot about the inner workings of Congressional hearings. Apparently, during some of these Trump-bashing hearings, Democrats hold focus groups watching TV in anterooms ... and reacting to what is happening live. Then when a key thought or phrase comes forth from the focus group members, runners bring them to the Democrat chairman or member so that he/she can launch a sound-bite question or zinger at the witness.

 So, these slow-witted politicians can then seem a lot sharper than they really are ..

Pulling off the Scab


Robert Mueller proved in his press conference today that he is still a despicable person. The primary purpose of his (shaky) words was to pull the scab off of  any public healing that has occurred after his report was released.

By innuendo and implication he hinted that there was some sort of improper cooperation between Trump and the Russians ... cowardly and shameful! And then went on to condemn Trump for obstruction of justice with these weasel words, “if we could have exonerated the president of this charge, we would have said so.” How very kind of him. It doesn’t take Noam Chomsky to translate these words as “he did it, but charging him would be against DOJ guidelines ... so it is up to you Congress.” How sneaky and snidely can you get? While he stood there consuming his cake, it was miraculously still there.

He also said in passing three other things:

1) He won’t voluntarily testify in front of Congress ... and, if subpoenaed, will not comment on anything outside the boundaries of his report. In other words, he will not answer the many embarrassing questions about when he knew there was no collusion or why he didn’t investigate how Hillary and the Democrats obviously DID collude with the Russians. He is effectively inoculating himself against taking the Fifth.

2) The special counsel’s job is over and so he is leaving the Department of Justice and his team is dissolved.

3) (By implication) if Bob Woodward is correct and someone in his office did draw up an obstruction of justice indictment, this was undone because it was unconstitutional and can only go forward as an impeachment process in Congress. Hint, hint.

From now on, this man should only be known as Snidely Mueller.

Birthright


My daughter, like many young women, a liberal, was upset this morning because of Trump's threat to issue an executive order eliminating birthright citizenship. Now, this obviously seems a pre-midrem stunt and likely will not happen. But, as I explained to my daughter, there are lots of foreign women who fly to the U.S., have their baby, then fly home ... giving their child American citizenship ... not fair. However, it is very unlikely that Congress and/or the courts will let Trump have his way with such an executive order.

But, I have a suggestion -- Congress should pass a law or, if necessary, a Constitutional amendment, restricting birthright citizenship to only those who, if born in the U.S. of aliens, must also live here until the age of 5 and cannot have been wards of the state in the meantime.

Pardon Me ...


Obviously, I am not a lawyer.  But I do have some legal thoughts about Rudy Giuliani's comment that President Trump could pardon himself if need be. My logic also involves the answer to another conumdrum -- whether a president can be indicted. I think this is clearly unconstitutional because the constitutional cure is impeachment for "high crimes, etc."

Let's assume that President Trump invites James Comey to the White House where he shoots him dead.  He cannot immediately be indicted for this crime. Constitutionaly he would first have to be impeached by the House and then convicted in the Senate to be removed from office (a process I am pretty certain that SCOTUS would not permit him to pardon himself from.) This should be a very quick event. Only then could he be indicted and brought to justice in our regular criminal system.

But here is the rub. Trump could not then pardon himself because he no longer would be president. And, I could be wrong, but I don't think that Trump could give himself a prospective pardon ... before the above die process was completed ... while he was still president.

Therefore, all this hot air about him pardoning himself is just that ...hot air.

Unmasking


No, this posting is not about the deep state's duplicitous revealing of hundreds of Trump campaign staffer's names in NSA intercepts. It's about Congress' hiding their votes for unpopular things like the "carried interest" tax treatment.

There needs to be an unmasking of all those pretenders in Congress regarding their position on this special tax rate for hedge fund managers. Now that the Republican tax reform package has been passed, there is now an opportunity for some brave lawmaker to introduce a law specifically rescinding this 15% carried-interest tax treatment. Nothing else included ... just this one item ... no other provisions to hide behind or confuse things. Wouldn't it be great to see exactly how all in Congress, Democrat and Republican, feel about this specific tax give-away?

I think we might see some surprises as to who votes yea and nay. Only one problem, however ...

It will never happen ... for the obvious reason that no one there wants such a political unmasking.

Safety in Numbers


Weinstein? Who is Harvey Weinstein? Since we were treated to our first sexual perv, there has been such a flood of like-minded miscreants, that we have almost forget who opened the spillway. Now, the lawyer for perv Rep. John Conyers is threatening to reveal the dozens if not hundreds of Congresspersons (there has to be at least one female) who have engaged in inappropriate horizontal cha-chas on Capitol Hill.

This sounds like a safety in numbers strategy on this lawyer's part and, I strongly suspect, it just might work. So, if the 254 lechers are revealed whose payoffs cost us taxpayers around $16 million ... plus those 50 on the current Congressional "creep list" are unmasked, the print media should have enough fodder to feed a cattle drive. And John Conyers (and Al Franken) can lose themselves in this crowd.

And what might the political persuasions of these over 300 pervs be? My money is on at least 75% Democrats. If not, I'll down a hefty dose of Fletcher's Castoria ...

Afterward: I think I just figured out why they call themselves "congress" ...

What Happens in Vegas ...


The mystery surrounding the recent Las Vegas massacre of 58 and injuring of over 500 country and western concert goers from rooms on the 32nd floor of the Mandalay Bay hotel is getting curiouser and curiouser. In particular, there are growing questions about the timeline of events inside the hotel and the response to these events ... see: LA Times Article. I, myself, have given up on trying to unravel these things.

This sewing of confusion by both the hotel and Las Vegas law enforcement is quite understandable to me for one simple reason -- money. The potential monetary liability to the hotel and the city from the hundreds or possibly thousands of plaintiffs in this case is beyond enormous ... which means that shrouding of derrieres is taking place to a fair-thee-well ... and will continue until such time as some unaffected thitd party steps in and runs things ... say the FBI or even Congress.

Las Vegas is riddled with sweetheart dealing and corruption which, IMHO, is why things surrounding this massacre are so roiled. I expect we will never know the true story there as long as these shady players keep things, that happen Vegas, staying in Vegas.
