Exculpatory Evidence


Exculpatory evidence is evidence that tends to show the innocence of the accused.

If someone is on trial and the prosecution withholds exculpatory evidence from defense lawyers, then the defendant is (or should be) found not guilty by reason of prosecutorial misconduct.

Is Adam Schiff not withholding exculpatory evidence in his Impeachment Inquiry hearings? Like the name of the whistleblower?


Questionable


To me, there were at least five questionable elements in the first Impeachment Inquiry hearing yesterday:

1) Intelligence Chairman Rep. Adam Schiff asserted repeatedly that he doesn’t know the identity of the whistleblower! He is clearly lying. For this to be true, Schiff either is not managing his staff ... or he is grossly incompetent. Neither can be true.

2) Before Ambassador Taylor accepted the top job in the Ukraine from SecState Pompeo, he testified he told Pompeo he would resign if we did not continue to support Kiev. If Trump had actually withheld such aid illegally, as Taylor has claimed, how come he didn’t resign? This failing clearly contradicts his testimony or sullies his character.

3) If Trump was forcing the president of the Ukraine into a quid pro quo, how come the president of this country did nothing to investigate its involvement in the 2016 American election ... or the Burisma use of Hunter Biden to influence our policy there? Nothing was done for over six weeks between the infamous phone call and the release of the aid, yet Trump’s supposed threat was not carried out.

4) Adam Schiff interrupted the Republicans at least twice in their questioning of the witnesses. He did not interrupt the Democrats at all. He also refused to hold a vote on calling the whistleblower to testify. Instead, he held a vote on tabling the motion on calling the whistleblower. Very shifty!

5) The Dems are now accusing Trump of (since it must be a high crime) bribery with his withholding of Ukrainian aid awaiting an investigation of 2016 election tampering and general corruption. Isn’t this backwards? Wouldn’t bribery require Trump to be bribed ... not he being the briber? Using this notion, wouldn’t all charity auctions be bribery? Anyway, it sure sounds evil ... and that's what counts.

Plenary Powers


The majority party in the House has “plenary powers.” This means that they can set the rules ... any rules they want ... fair or unfair. Depending upon how Nancy Pelosi and Adam Schiff wield these plenary powers in the upcoming Impeachment Inquiry public hearings will be the touchstone for the American public.

A perfect test of Democrat fairness will be which Republican-preferred witnesses Schiff allows to be called. And any that he disallows might (should) be allowed when this process moves to the House Judiciary Committee for an actual impeachment vote. And MUST be allowed if this process moves to the Senate for a trial.

Be careful Dems!

Afterward: Good reason that the Dems might not, in the end, vote for impeachment ... or even move this kangaroo process to the House Judiciary Committee ... hoping that Schiff can damage Trump enough in the Intelligence Committee to ruin his chances for re-election. See: Witness List Request.

Pulling the Wool


Today’s vote on the Impeachment Inquiry is a sham. Nancy Pelosi and Adam Schiff have tried to pull the wool over the American voters eyes. Instead of a traditional impeachment process like what was used for Richard Nixon and Bill Clinton, the vote taken today is for a process so unfair, so dictatorial that Democrats are hoping that American voters don’t find them out.

Well, I will do my small part here to burst that balloon. Two days ago I referenced this resolution ... and I need to repeat the actual plain text HERE. Republicans yesterday tried to amend this bill to make it passably fair. All 17 attempts were beaten back by the House Democrat majority ... see: C-SPAN video of Rules Committee meeting. Kind reader, take at least a half hour to watch what these Dems are pushing with this phony resolution.

Basically, instead of opening an impeachment inquiry in the Judiciary Committee, this resolution authorizes seven other committees to conduct fishing expeditions to try to find some dirt on Trump. (Perhaps, he once kicked a puppy?) And each of these House committees are given the same Gustapo-like authorities that Sniff has been using in his secret Star Chamber — no White House Counsel, no right to call witnesses, the opposition can only ask questions approved by the chairman, etc. These tactics are draconian, yet the Dems somehow think they are being fair. Their white-hot hate of Trump has obviously twisted their logic into unconstitutional illogic.

It is only after these effective seven special prosecutors have completed their fishing trips that the Judiciary Committee comes into play ... like what happened with Nixon and Bill Clinton. I can’t imagine that this might not happen until late next year. How interesting?

The Dems today might succeed in pulling the wool over America’s eyes ... but I can’t fathom the damage that this process will have done to our legislative process. Basically, they will be then empowered to negate the powers of the presidency with Fascrism dressed up as faux fairness.

Afterward: Even though this resolution is more onerous than the present process, the Dems will use this fake vote to try to badger Trump into cooperating with these 7 committee chairmen ... and most of the media will concur. Will theAmerican people understand this scam ... or is it too much in the weeds? Pelosi is betting on the latter.

Kangaroo Court


Interesting news nuance: If Nancy Pelosi does not cause a full House of Representatives vote on the Trump impeachment inquiry, then, of course, she protects all those Democrats who have been recently elected from districts that Trump won in 2016. But there are two other more important reasons for this sham. Without a full House vote, the Republicans have no subpoena powers nor can witnesses have White House counsel present in this possibleTV spectacle. Thus, Republicans cannot call any witnesses or influence the agenda of this kangaroo court. As a consequence, the Trump administration has refused to honor any of Pencil Neck’s subpoenas until a full house vote is held ... which refusal obviously will also be trumpeted as more obstruction by the president.

Now, dear reader, you know the rest of the story ...
